Terms of Service

These Terms of Service (“Terms”) govern your use of FunnyOrDye.com and purchases from Funny Or Dye (“Funny Or Dye,” “we,” “us,” or “our”). By using the site, creating an account, or placing an order, you agree to these Terms and the policies linked here. If you do not agree, do not use the site or place an order.

Using the site

You must be able to enter a binding contract where you live. You agree to provide accurate information, protect your account credentials, and promptly update information that changes. You may not use the site to violate law, interfere with security or operation, scrape or copy the catalog at scale, introduce malicious code, abuse promotions, impersonate another person, or infringe anyone’s rights.

Products, mockups, and sizing

Most products are made to order after purchase. Product images are digital mockups. Placement, scale, color, texture, and print appearance can vary slightly because of garment construction, screen settings, materials, and production methods. Those normal variations are not necessarily defects. Review the description, variant, color, and product-specific size information before ordering; a familiar size label is not a universal measurement.

We may correct descriptions, pricing, availability, or other errors and may limit quantities. If a material correction affects an order that we cannot fulfill as placed, we will contact you and provide the options required by applicable law.

Orders and acceptance

An order submission is an offer to buy. An automated confirmation means we received the request; it does not guarantee acceptance or production. We may reject or cancel an order before fulfillment for reasons such as unavailable products, suspected fraud, an obvious price or description error, a payment problem, prohibited content, delivery restrictions, or an inability to fulfill. If we cancel after capturing payment, we will refund the canceled amount to the original payment method.

Prices, payment, and taxes

Prices are shown in U.S. dollars unless the site clearly says otherwise. Shipping charges, discounts, and any applicable taxes are shown during checkout before you place the order. You authorize the selected payment provider to charge the total shown. Payment-provider terms may also apply. A bank or card issuer may apply its own conversion or processing fees.

Production, shipping, and delivery

Production and delivery estimates are estimates, not guarantees. Items in one order may be produced or delivered separately. We will ship within the time stated or otherwise handle a delay, cancellation, and refund as required by applicable law. Risk of loss and legal title transfer as provided by applicable law; nothing in these Terms shifts carrier risk to you where the law does not allow it. Changes, cancellations, returns, and refunds

Because products are made to order, the window to change or cancel an order may be very short and closes once production begins. We do not generally accept returns or exchanges for a change of mind, a customer-selected wrong size or color, or an incorrect customer-provided address. We do provide remedies for damaged, defective, materially misprinted, or incorrect items when reported as described in our returns policy. Mandatory consumer rights always control where they provide a different result.

Promotions and giveaways

A promotion may have separate official rules. Those rules control that promotion if they conflict with these Terms. Unless official rules for an active promotion say otherwise, no purchase is necessary to enter or win, and a purchase does not improve the odds. Do not rely on an old promotion page; verify the posted entry period and rules.

Intellectual property

The site, brand, artwork, product designs, photos, text, graphics, and other content are owned by Funny Or Dye or used with permission and are protected by intellectual-property laws. You may use the site for personal shopping. You may not reproduce, manufacture, sell, license, distribute, modify, or commercially exploit our content without written permission. Product ownership does not transfer rights in the printed design.

Third-party services and links

The site relies on third parties for services such as payment, production, shipping, analytics, and hosting and may link to other sites. Their separate terms and privacy practices may apply. We are not responsible for third-party sites we do not control, but this does not limit our obligations to you as the seller where applicable law says otherwise.

Disclaimers

To the fullest extent permitted by law, the site and its content are provided “as is” and “as available,” and we disclaim implied warranties not expressly provided in these Terms. We do not promise uninterrupted or error-free access. Some jurisdictions do not allow certain warranty exclusions, so some of this section may not apply to you. This section does not limit any warranty or remedy that cannot legally be limited.

Limitation of liability

To the fullest extent permitted by law, Funny Or Dye will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data, arising from use of the site or a product. Our aggregate liability for a claim related to an order will not exceed the amount paid for the product giving rise to the claim. These limits do not apply to liability that cannot legally be excluded or limited, including mandatory consumer protections.

Governing law and disputes

These Terms are governed by the laws of California and applicable United States federal law, without regard to conflict-of-law principles, except that mandatory consumer protections in your home jurisdiction remain available. Before filing a dispute, please email admin@funnyordye.com so we can try to resolve it informally. A dispute may be brought in a court with lawful jurisdiction. These Terms do not require arbitration or waive a right that cannot be waived by contract.

Changes and general terms

We may update these Terms prospectively by posting a revised version and changing the date above. The Terms in effect when an order is placed generally govern that order unless law requires otherwise. If one provision is unenforceable, the remaining provisions continue. A delay in enforcement is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transfer subject to law. These Terms and the incorporated policies are the entire agreement about the site and purchases.
